• “Services” refers to all digital marketing, Daraz account handling, eCommerce store management, Shopify services, and any consulting or execution service provided by Ecomsavy.

• “Website” means all content and infrastructure accessible via www.ecomsavy.com.

2. Contract with You

• By purchasing services or creating an account, you enter into a legally binding agreement with Ecomsavy.
• Services are subject to availability and acceptance by Ecomsavy.
• Ecomsavy reserves the right to accept or reject any request without obligation to provide a reason.

3. Eligibility

You must be at least 18 years of age to use our services. By using our services, you confirm that you meet this requirement.

4. Account Responsibilities

• You are responsible for maintaining the confidentiality of your account credentials.

• Any activity under your account is your responsibility, and Ecomsavy will not be liable for unauthorized access.

5. Pricing, Payment, and Billing

• Prices are listed in PKR and may change without notice.

• Full or partial advance payment may be required before service provision begins.

• Invoices must be settled by the due date. Late payments may result in service suspension and/or additional fees.

• No service is considered confirmed without written acknowledgment from Ecomsavy.

6. Refund & Cancellation Policy

• All service purchases are final unless explicitly stated otherwise in writing.

• Custom services (including Daraz or Shopify account setups and marketing plans) are non-refundable once the project has started.

• If you cancel a service mid-way, no refund will be provided for work already delivered or in progress.
• Ecomsavy reserves the right to terminate services with immediate effect for misconduct, non-payment, or breach of terms.

7. Guarantees & Limitations

• While we commit to delivering professional-grade work, we do not guarantee specific sales, revenue, or platform growth metrics.

• All client-side obligations (e.g. product availability, pricing, communication responsiveness) must be fulfilled for successful outcomes.

• Delays due to third-party platforms (like Daraz or Shopify) are beyond our control and not grounds for refund.

8. Intellectual Property

• All strategies, tools, campaigns, visuals, and documentation provided by Ecomsavy remain the intellectual property of the company unless explicitly transferred in writing.

• You are granted a limited, non-transferable license to use deliverables for your business only.

• Unauthorized reproduction, resale, or redistribution is prohibited.

9. Use of Client Assets

You hereby authorize Ecomsavy to use your logos, branding, photos, and business assets solely for the provision of agreed-upon services, unless otherwise agreed in writing.

10. Confidentiality

Ecomsavy agrees to keep your sensitive business information confidential. However, you also agree not to publicly disclose proprietary methods, software tools, or strategies used by Ecomsavy during your engagement.

11. Acceptable Use

You agree not to use our platform or services for:

• Illegal or unethical purposes
• Uploading harmful, abusive, or defamatory content.
• Violating any intellectual property rights

Violation of this policy can result in termination of your access with or without notice.

12. Limitation of Liability

• Ecomsavy is not liable for any indirect, incidental, or consequential damages resulting from use of our services or platform.

• Our liability for any direct claim is limited to the amount paid by you for services in the previous 30 days.

13. Service Availability

We strive to maintain uptime and quality service, but do not guarantee uninterrupted access. Scheduled maintenance or external issues may cause temporary disruption.

14. Dispute Resolution

In case of disputes, both parties agree to attempt resolution through mediation before taking legal action. Legal jurisdiction will be the courts of Pakistan.

15. Modification of Terms

We reserve the right to update or modify these terms at any time. Continued use of our services implies acceptance of the revised terms.

16. Termination

We may terminate access or suspend services if you:

• Breach these terms

• Fail to make timely payments

• Misuse the platform or defame our brand

17. Third-Party Platforms

We are not responsible for changes in Daraz, Shopify, Facebook, or other platform policies that affect your account or performance.

18. Communication Consent

You agree to receive service-related communications from Ecomsavy via email, WhatsApp, or SMS, including updates, billing reminders, or project-related discussions.

19. Governing Law

These Terms are governed by the laws of Pakistan. Disputes will be settled in Karachi courts.

By using our services, you acknowledge that you have read, understood, and agreed to these Terms.
